Refund Policy

This Refund Policy (“Policy”) is a binding agreement between Melodream Studios (“Melodream Studios“, “Company”, “We”, “Our”, or “Us”), and the purchaser (“Client”, “You”, or “Your”). This Policy applies to all purchases made by the Customer of intellectual property (“IP”) through the Melodream Studios website or any other platform controlled by Melodream Studios, including, but not limited to, song, digital assets, artwork, music, software, designs, trademarks, or any other IP.

By placing an order or purchasing any intellectual property from Melodream Studios, you agree to the terms of this Refund Policy as outlined below.

 

No Refund or Non-Refundable Purchases

All intellectual property purchases made from Melodream Studios are final and non-refundable. As we provide personalized and creative services once payment has been processed, no refunds will be issued under any circumstances.

 

Justification for Non-Refundable Purchases

We believe our Non-Refundable Purchases is fair and justified for the following reasons:

  • Personalized and Custom Services: Our services are deeply personalized and tailored to each client’s unique requirements and stories. Each song is custom-written and produced specifically for you or your intended recipient.
  • Commencement of Creative Work: Once an order is placed and payment is received, our team of songwriters, composers, and producers immediately begins the creative process, allocating their time, skills, and resources to your project. This includes initial consultations, creative brainstorming, lyrical drafting, music composition, and production planning, even before any draft is presented to the client.
  • Irreversible Creative Effort: The creative work invested is inherently irreversible and cannot be “returned” or resold. Once our creative team has started working on your song, the value is in the creative effort and time invested, regardless of whether the final output perfectly matches subjective client expectations (which, by nature of art, are inherently variable).
  • Revisions Process Available: We offer a revision process as part of our service packages to address reasonable client feedback and make adjustments to the song within the scope of the original service description. The revision process is designed to ensure client satisfaction within the agreed-upon scope of the service.
  • Risk of Subjective Dislike: Music and artistic taste are inherently subjective. We cannot guarantee that every client or song recipient will be completely satisfied with the creative style, genre, or emotional tone of the final song, as long as it generally aligns with the client’s initial brief and agreed service description. Refunds will not be provided due to subjective dissatisfaction with creative aspects that fall within the agreed-upon scope and general artistic interpretation.

 

Limited Exceptions – At Sole Discretion of Melodream Studios

While our general policy is “No Refunds,” Melodream Studios may, in very exceptional and limited circumstances, consider a refund at its sole and absolute discretion. These exceptions are not guaranteed and are evaluated on a case-by-case basis. Examples of circumstances where a refund might be considered (but are not guaranteed) include:

  • Service Unavailability Due to Studio Error: If Melodream Studios is demonstrably unable to provide the agreed-upon services due to a significant error or fault on our part (e.g., studio closure due to unforeseen circumstances, critical technical failure preventing service delivery after payment).
  • Complete Non-Delivery (After Payment): If, through a demonstrable error on our part, Melodream Studios fails to deliver any song whatsoever after full payment has been received and a reasonable timeframe for delivery has passed (excluding delays caused by client inaction or revisions process).
  • Major Quality Deficiencies (Demonstrably Studio Error & Irreparable via Revisions): In extremely rare cases where a client can demonstrably prove a fundamental and significant flaw in the song quality directly attributable to a clear error or gross negligence on the part of Melodream Studios (and not subjective stylistic preferences), and if such quality issues are demonstrably irreparable even after reasonable revision attempts. This is highly subjective and will be assessed rigorously.

Even in these exceptional circumstances, any decision to offer a refund, and the amount of any such refund (which may be partial), remains entirely at the sole and absolute discretion of Melodream Studios. There is no automatic entitlement to a refund even if one of these circumstances might appear to apply.

 

No Refunds for Subjective Reasons or Client Change of Mind

Refunds will NOT be provided under any circumstances for reasons including but not limited to:

  • Subjective Dissatisfaction with Creative Style: Disliking the genre, vocal style, melody, lyrical tone, or overall creative interpretation of the song, as long as it generally aligns with the initial client brief and service description. Music taste is subjective. While we do not guarantee complete satisfaction with the final product, we strive to work closely with you to ensure the highest quality of service. We will do our best to address any concerns or issues through revisions or adjustments. However, we do not guarantee that the final product will meet your exact vision or that it will be accepted by you or the recipient.
  • Change of Mind or Cancellation (After Work Commences): If a client changes their mind, decides they no longer want the song, or wishes to cancel the order after creative work has commenced (even if drafts have not yet been presented), refunds will not be provided due to the effort already invested.
  • Recipient’s Reaction to the Song: Melodream Studios is not responsible for the recipient’s personal reaction to the song or whether it achieves any specific emotional or personal outcome. The impact of music is subjective and unpredictable.
  • Delays Caused by Client Inaction or Revision Process: Delays resulting from client feedback delays, revision requests, or communication delays from the client are not grounds for a refund.
  • Minor or Correctable Issues: Minor issues or aspects of the song that can be reasonably addressed through the standard revision process are not grounds for a refund. The revision process is intended to handle such refinements.
  • Circumstances Beyond Melodream Studios’ Control: Events or circumstances beyond our reasonable control (force majeure, client-side issues, recipient-related events, etc.) are not grounds for a refund.

 

Revision Process as Primary Resolution

Melodream Studios is committed to client satisfaction and offers a revision process as part of many service packages. The revision process is the primary and intended mechanism for addressing client feedback and making adjustments to the song to achieve a satisfactory result within the agreed-upon service scope. Clients are encouraged to utilize the revision process to resolve any concerns or dispute rather than seeking a refund.

 

Requesting Consideration for Exceptional Refund

If you believe your situation falls within the very limited exceptional circumstances outlined in Section 3, and you wish to request consideration for a potential refund (while understanding that refunds are not guaranteed), you must submit a formal refund request in writing to [Your Designated Email Address for Refund Requests – e.g., [email address removed]] within [Number, e.g., 7] days of the issue arising. Your request must include:

  • Your Invoice Number and Order Details.
  • A clear and detailed explanation of why you believe your situation qualifies for one of the limited exceptions outlined in Section 3.

Melodream Studios will review your request on a case-by-case basis and will notify you of our decision. Please note that the decision regarding any refund is solely at the discretion of Melodream Studios, and our decision is final.

 

Payment and Refund for Third-Party Services

If you make use of any third-party services (such as music licensing, distribution services, video production platforms, etc.) through Melodream Studios, you understand that these services may have their own refund policies. We are not liable or responsible for refunds relating to third-party services, and any issues regarding third-party services must be addressed directly with the service provider.

 

Modifications to this Refund Policy

We reserve the right to modify, update, or change this Refund Policy at any time. The most current version of the Refund Policy will be available on our website. By continuing to use our services after any changes to this policy, you agree to be bound by the revised terms.
